Politicker is reporting that after both sides withdrew objections to the 41 ballots, Storobin's lead grew to 2.
Meanwhile, both sides are scheduled to appear in court tomorrow.
Also, in Fidler's court filing, the candidate reserves the option to sue the Board of Election in Federal court.
The main accusation in the papers surrounds Alla Pometko, a Storobin campaigner, who applied for 177 absentee ballot; 120 of them were returned, filled out with the same hand-writing; a number of them had only a mark, instead of a signature; 16 of those who claimed disabilities showed up on Election Day to vote in person. Their absentee vote was properly tossed, but their appearance proves that Pometko fraudulently filed for absentees. The 104 remaining ballots ordered by her presumably make up the bulk of the Fidler challenges.
If Fidler fails, he lays out a case against the BoE that he plans to take to the Federal court, for invalidating approximately 200 absentee ballots because the envelopes weren't signed. He claims that other BoEs typically return such ballots to the voters to correct them, when there is sufficient time until election date. By not doing that, Fidler claims, the board violated their voting rights.
